These Terms and Conditions (“Terms”) govern your use of our websites, including Sun2Spain.com, and the booking of our tours, excursions, experiences, and related services.

 

By accessing our website or making a reservation with us, you acknowledge that you have read, understood, and agree to be bound by these Terms.

MB Sun2Fun Tours operates under the umbrella brand Sun2Fun Tours, which includes the following destination-specific trading brands:

 

• Sun2Spain – Tours and experiences in Spain

• Sun2Italy – Tours and experiences in Italy

• Sun2Greece – Tours and experiences in Greece

• Sun2Egypt – Tours and experiences in Egypt

 

Unless expressly stated otherwise, all bookings made through any of these brands are entered into with MB Sun2Fun Tours and are governed by these Terms and Conditions.

 

References throughout these Terms to “Sun2Fun Tours,” “Sun2Spain,” “Sun2Italy,” “Sun2Greece,” “Sun2Egypt,” “we,” “our,” or “us” refer to MB Sun2Fun Tours.

3. Services

 

Sun2Fun Tours provides guided tours, excursions, travel experiences, and related tourism services in Spain, Italy, Greece, Egypt, and other destinations where offered.

 

All services are subject to availability and may be modified where necessary due to operational requirements, weather conditions, safety considerations, force majeure events, or circumstances beyond our reasonable control.

4. Bookings & Payments

 

• A booking is confirmed only after full payment has been successfully received unless otherwise agreed in writing.

• Payments are processed securely through authorized third-party payment providers, including but not limited to Stripe and PayPal.

• Customers are responsible for ensuring that all booking information provided is accurate and complete.

• We reserve the right to refuse or cancel any booking where incorrect information has been supplied or where payment cannot be verified.

5. Cancellations & Refunds

 

Due to the nature of our services, which are provided on specific dates and times, bookings are exempt from the statutory right of withdrawal in accordance with Article 16(l) of Directive 2011/83/EU relating to leisure services.

 

Customer Cancellations

 

• More than 72 hours before the scheduled tour: eligible for a refund minus any non-recoverable costs already incurred (such as entrance tickets or third-party reservations).

• Less than 72 hours before the scheduled starting time, or failure to attend (no-show): no refund will be provided.

 

Cancellations by Sun2Fun Tours

 

If we must cancel a service due to force majeure, safety reasons, operational necessity, or failure to reach the required minimum number of participants (where applicable), customers will be offered either:

 

• an alternative date or service; or

• a full refund.

 

Payment Processing Fees

 

Approved refunds are subject to deduction of any non-refundable payment processing fees charged by third-party payment processors.

 

These fees are not recoverable by Sun2Fun Tours once the original transaction has been completed and therefore cannot be refunded. The refunded amount will equal the total payment received minus the applicable payment processing fees and any other non-recoverable costs described above.

6. Customer Responsibilities

 

Customers agree to:

 

• Arrive at the designated meeting point on time.

• Follow all reasonable instructions given by the guide.

• Respect local laws, customs, heritage sites, staff, and fellow participants.

• Ensure they are physically capable of participating in the booked activity.

 

Sun2Fun Tours reserves the right to refuse participation or remove any customer whose behaviour is unsafe, disruptive, abusive, or likely to negatively affect other participants. In such cases, no refund will be due.

7. Chargebacks & Payment Disputes

 

If any issue arises regarding a booking, customers should contact Sun2Fun Tours first so that we can attempt to resolve the matter promptly.

 

Where an unjustified chargeback is initiated without prior contact, we reserve the right to contest the dispute by submitting evidence of the booking, communications, attendance records, and any other relevant documentation to the payment provider.

 

Nothing in this clause affects your legal right to dispute a payment in cases of genuine fraud or where services were not provided.

8. Reviews & Customer Feedback

 

We value honest customer feedback.

 

Constructive reviews help us improve our services and assist future travellers.

 

However, we reserve the right to pursue appropriate legal remedies where reviews contain knowingly false, defamatory, abusive, fraudulent, or misleading statements that unlawfully damage our reputation.

 

Nothing in this clause limits your legal right to express your genuine opinion.

9. Liability

 

To the fullest extent permitted by applicable law, Sun2Fun Tours shall not be liable for:

 

• Delays or cancellations resulting from force majeure.

• Weather conditions.

• Transport disruptions.

• Government restrictions.

• Closure of attractions.

• Loss, theft, or damage to personal belongings.

• Injuries resulting from failure to follow safety instructions or from a participant’s own negligence.

 

Except where liability cannot legally be excluded, our total liability shall not exceed the amount paid for the affected booking.

10. Insurance

 

Customers are strongly advised to obtain suitable travel insurance covering, where appropriate:

 

• Trip cancellation.

• Medical expenses.

• Personal accidents.

• Personal belongings.

• Travel disruption.

11. Intellectual Property

 

All content appearing on our websites, including but not limited to text, photographs, graphics, logos, videos, designs, downloadable materials, branding, trademarks, and software, is owned by or licensed to Sun2Fun Tours and is protected by copyright, trademark, and other applicable intellectual property laws.

 

No content may be copied, reproduced, distributed, published, modified, or used without our prior written permission.

12. Governing Law & Jurisdiction

 

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Lithuania.

 

Where permitted by applicable consumer protection legislation, any disputes arising from these Terms shall be subject to the competent courts of the Republic of Lithuania.

 

Nothing in this clause limits any mandatory consumer rights available under applicable European Union legislation or the mandatory laws of the consumer’s country of residence.

Nothing contained in these Terms excludes or limits any mandatory rights granted to consumers under applicable European Union legislation or the laws of the consumer’s country of residence where such rights cannot legally be excluded.

14. Digital Content Licence

 

All digital content made available by Sun2Fun Tours, whether free of charge or as part of a booking—including, but not limited to, travel guides, itineraries, checklists, eBooks, PDFs, maps, photographs, and other downloadable materials (“Digital Content”)—remains the exclusive intellectual property of Sun2Fun Tours.

 

Customers receive a limited, non-exclusive, non-transferable, revocable licence to download and use such Digital Content solely for their personal, non-commercial use.

 

Without our prior written consent, you may not:

 

• Copy or reproduce the Digital Content.

• Distribute or share the Digital Content with third parties.

• Modify or create derivative works.

• Sell, licence, rent, publish, or otherwise commercially exploit the Digital Content.

• Remove copyright notices or other proprietary markings.

 

Any breach of this licence automatically terminates your right to use the Digital Content. Sun2Fun Tours reserves all rights not expressly granted in these Terms.
